What rights do I have being a pregnant wife and my husband files for divorce?

If you are divorcing in Florida while pregnant, your rights are shaped by both the duration of your marriage and the upcoming birth of your child. Because of the short duration of your marriage, you will not be entitled to spousal support.

Once the baby you are pregnant with is born, you can seek child support from your husband. Unless you and he acquired property or assets during the marriage, it sounds like child support will be the only thing you are entitled to. Keep in mind that Florida courts often delay the final judgment of dissolution until after the birth to ensure that paternity, a parenting plan, and support orders are properly established for the newborn.
